HOUSE RENTAL LIABILITY WAIVER & SAFETY AGREEMENT

Customer / Responsible Adult:

1. ASSUMPTION OF RISK

I understand that use of inflatable bounce houses involves inherent and foreseeable risks, including falls, collisions, trips, slips, sprains, fractures, bruises, cuts, equipment failure, weather-related hazards, and other injuries. I voluntarily accept these risks on behalf of myself and, where legally permitted, the participating minors in my care.

2. RELEASE AND WAIVER

To the fullest extent permitted by applicable California law, I release, waive, and agree not to hold Bounce Away LA, its owners, employees, contractors, agents, and representatives responsible for claims, injuries, damages, or losses arising from or related to the use of the rental equipment, including claims based on the ordinary negligence of Bounce Away LA, or its owners, employees, contractors, agents, or representatives, except to the extent such liability cannot legally be waived.

3. CUSTOMER RESPONSIBILITY FOR SAFE USE

I agree to follow all manufacturer instructions and the safety rules below and to ensure that all participants do the same.

4. REQUIRED SAFETY RULES

Adult supervision is required at all times. Follow the manufacturer’s stated age, height, weight, and occupancy limits. No flips, wrestling, roughhousing, tackling, pushing, fighting, or intentional collisions. No climbing on walls, nets, or exterior surfaces. No hanging from the inflatable. No shoes, food, drinks, gum, toys, sharp objects, jewelry, or other items that could damage the unit. No pets or animals inside the inflatable. Participants must use designated entry and exit areas. Do Not move, alter, deflate, re-anchor, unplug, or otherwise tamper with the equipment. Participants must exit immediately if instructed by Bounce Away LA or if unsafe conditions develop. Report any damage, malfunction, unusual noise, or loss of inflation immediately.

5. WEATHER AND WIND

Inflatables may not be operated in unsafe weather conditions. Bounce Away LA may delay, suspend, or terminate use when conditions are unsafe, including excessive wind, lightning, heavy rain, or other hazardous conditions. Customers must follow any safety direction given by Bounce Away LA.

6. SETUP AND EQUIPMENT

I understand that Bounce Away LA will determine the appropriate setup location and anchoring method based on the equipment, surface, access, and conditions. I agree not to relocate or modify the equipment after setup.

7. SUPERVISION

I understand that the customer/responsible adult is responsible for providing competent adult supervision for the entire period the inflatable is accessible to participants. The responsible adult agrees to monitor participants and ensure that all participants follow the safety rules, manufacturer requirements, and instructions provided by Bounce Away LA. The inflatable must not be used without appropriate adult supervision

8. MEDICAL / ALLERGY INFORMATION

The responsible adult agrees to inform Bounce Away LA of any known medical conditions, allergies, or other relevant information that may affect a participant's ability to safely use the equipment. I agree to provide accurate information in the form above and to notify Bounce Away LA of any relevant changes.

9. PROPERTY DAMAGE

I am responsible for damage to the rental equipment caused by misuse, negligence, prohibited items, unauthorized movement or modification, or failure to follow the safety rules, except for ordinary wear and tear.

10. INDEMNIFICATION

To the fullest extent permitted by applicable California law, I agree to indemnify and hold harmless Bounce Away LA from claims, damages, or expenses arising from my breach of this agreement or misuse of the equipment, except to the extent such indemnification is prohibited by law.

11. ACKNOWLEDGMENT

I have read and understand this Liability Waiver & Safety Agreement. I understand that adult supervision is required at all times. I agree to follow all safety rules and manufacturer requirements. I understand that unsafe weather or operating conditions may require use to stop.

12. PARENT / GUARDIAN CONSENT FOR MINORS

I am the parent or legal guardian of the minor participant(s), or I have authority to provide consent on their behalf. I have reviewed the safety rules with them and consent to their participation subject to this agreement.

BOUNCE AWAY LA DEPOSIT, PAYMENT, CANCELLATION & RENTAL TERMS

1. $100 REFUNDABLE SECURITY DEPOSIT

A $100 deposit is collected at the time of booking in addition to the rental price. This deposit secures the customer's reservation and also serves as a security deposit for customer-caused damage, excessive cleaning, missing items, or other charges described in these terms. After the rental, Bounce Away LA will inspect the equipment. If the equipment and included items are returned in substantially the same condition as provided, ordinary wear and tear excepted, the $100 deposit will be refundable, subject to the cancellation terms below and applicable law.

2. RETURN OF SECURITY DEPOSIT

Bounce Away LA will generally return the $100 security deposit within 3 business days after the rental, following inspection of the equipment. If a deduction is made, Bounce Away LA may provide an explanation and documentation when reasonably requested.

3. POSSIBLE SECURITY DEPOSIT DEDUCTIONS

Possible deductions include customer-caused punctures, tears, burns, cuts, stains, excessive dirt or debris, pet contamination, unauthorized use, blower or electrical tampering, unauthorized movement or re-anchoring, missing equipment or accessories, and other customer-caused damage.

4. ADDITIONAL DAMAGE / CLEANING CHARGES

If the cost of damage, repair, replacement, missing items, or excessive cleaning exceeds the $100 security deposit, the customer is responsible for the remaining reasonable charges, subject to applicable law. Bounce Away LA may provide an explanation or documentation of such charges when reasonably requested.

5. CLEANING STANDARD

The customer agrees to return the inflatable free of food, drinks, gum, confetti, silly string, face paint, excessive mud, animal waste, and other avoidable contamination. Ordinary dust and normal use dirt are not considered excessive cleaning.

6. RENTAL PAYMENTS AND CUSTOMER CANCELLATIONS

Once a reservation is confirmed, rental payments are final and non-refundable, except where a refund is required by applicable law or Bounce Away LA voluntarily agrees otherwise in writing. The $100 deposit is subject to the refund and deduction terms described in Section 1 and Section 2. Lack of use, a change of plans, failure to attend the event, or concern about the forecast does not automatically entitle the customer to a refund.

7. WEATHER AND UNSAFE CONDITIONS

Outdoor weather may affect safe use of inflatable equipment. Customers are responsible for following all safety directions from Bounce Away LA. If the customer chooses to proceed with a rental despite a forecast and later chooses not to use the equipment, rental payments remain subject to the cancellation terms above. Bounce Away LA may delay, suspend, or stop operation whenever conditions are unsafe, including excessive wind, lightning, heavy rain, or other hazardous conditions. If Bounce Away LA determines before setup that conditions are unsafe and cancels the rental, Bounce Away LA may offer a reschedule or credit subject to availability and the terms communicated at that time. Any refund or credit remains subject to applicable law.

8. BALANCE DUE

The remaining rental balance is due before or at delivery/setup unless otherwise agreed in writing. Bounce Away LA may decline delivery or setup if the required balance has not been paid.

9. LATE RETURN / EXTENDED USE

Use beyond the agreed rental period may result in additional charges. Any extension must be approved by Bounce Away LA in advance when reasonably possible.

10. ACCESS AND SETUP CONDITIONS

The customer must provide safe and reasonable access to the setup location and disclose known hazards or restrictions, including sprinklers, underground hazards, overhead hazards, construction, restricted access, pets, or other conditions that could affect setup or safe operation.

11. CUSTOMER CHANGES

Changes to the event date, location, rental period, equipment, or other reservation terms require written approval from Bounce Away LA and may be subject to availability or additional charges.

12. CUSTOMER-CAUSED INTERRUPTION

If use is interrupted because of customer actions, prohibited use, failure to follow safety instructions, unsafe conditions created by the customer, or other customer-caused circumstances, rental charges do not automatically become refundable.

13. PHOTO / VIDEO DOCUMENTATION

Bounce Away LA may photograph or record the equipment before and after a rental for condition documentation, maintenance, and dispute-resolution purposes. Customer or child images will not be used for advertising or promotional purposes without appropriate permission.

14. DISPUTES AND RECORDS

Customers should contact Bounce Away LA in writing regarding any billing, damage, cancellation, or other rental dispute. The customer should retain this agreement, receipts, reservation information, and relevant communications. Nothing in these terms waives rights that cannot legally be waived under California law.

15. ENTIRE RENTAL TERMS

These terms, together with the applicable reservation information and the separately signed Bounce Away LA Liability Waiver & Safety Agreement, constitute the rental terms between the customer and Bounce Away LA. The two forms should be retained together. Any changes should be confirmed in writing.

16. CUSTOMER ACKNOWLEDGMENT

By signing below, I confirm that I have read and understand these Deposit, Payment, Cancellation & Rental Terms and agree to comply with them.
